In Germany, legal controls tightened in the early 2000s. A 2005 legal amendment prohibited the cultivation or sale of organic materials fr om which narcotic substances can be extracted, closing a loophole involving psilocybin mushrooms and similar fungi.

Today, recreational buying, selling, possessing, importing, or delivering psilocybin mushrooms in Germany is generally illegal. The lim ited exception is tightly controlled medical access: selected adults with treatment-resistant depression may receive psilocybin through a compassionate-use program at designated clinical facilities, with supervised treatment and psychotherapy—not commercial delivery.
